93H – Trespassing with or dangerous use of firearm or spear gun

It is an offence to enter a building or any type of public land (other than a road) with a firearm or spear gun, or an imitation firearm or spear gun. The penalty for this offence is 5 years imprisonment.

To avoid a conviction for this offence you must prove that you are the owner or occupier of the building or land or that you have the permission of the owner or occupier of that building or land to enter it with a firearm or spear gun. There must also be a reasonable excuse for doing this or a lawful purpose for doing it.

The penalty for this offence is 5 years imprisonment. If the firearm or spear gun is fired or discharged then the penalty increases to 10 years imprisonment.
